This page explains what we collect on kemalbrown.com, why, and what you can do about it.
Who we are
This website is operated by Kemal Brown, an individual (“we”, “us”). It is Kemal Brown’s personal website, and Kemal Brown is the “data controller” for the information described here. Kemal Brown is based in Kingston, Jamaica, and Jamaica’s Data Protection Act 2020 applies to how we handle your information.
Privacy questions: grow@kemalbrown.com
The contact and booking forms
If you use the contact form or the speaker booking form, we receive what you type: your name and email address, and, where you give them, your organisation, event date, location, audience size, format, topic, budget and message. We use it only to reply to you and, for bookings, to plan the event. We don’t sell it or share it for marketing.
How it works: the forms are handled on our website hosting and delivered to our team’s inbox by email through our email provider. A backup copy of each message is kept on our server in case an email goes astray. To block spam, the forms include a hidden field and measure how long the page was open before sending, and we keep a short-lived, scrambled (hashed) version of your IP address to limit repeated submissions. We never store your IP address in readable form for this purpose.
The newsletter, podcast updates and Speaker Kit
If you subscribe on the Author page, we keep your first name and email address to send you Today’s Cure, a free daily thought by email. If you ask to hear when the podcast launches, we keep your email address and email you only about the podcast. If you ask for the Speaker Kit on the Speaker or Press kit page, we keep your name and email address to send you the download links, and we may email you about Kemal’s speaking; you can unsubscribe at any time. When you sign up, our team also receives a short email alert with your details.
Subscriptions are managed by our newsletter (email marketing) provider, which sends our emails and stores the list. Every email has a one-click unsubscribe link, and you can ask us to delete your details at any time.
If you subscribed on an earlier version of this site (for example, for the free e-book and weekly motivation), your email address and first name have moved to our newsletter provider, and our first email tells you why you’re receiving it. You can unsubscribe with one click.
Cookies and analytics
This site works fully without any cookies, and nothing optional runs until you choose. The first time you visit, a short notice asks what you’re happy with: Accept all, Reject all, or Manage to choose category by category.
Essential (always on). The site sets no cookies of its own. Two small notes are kept in your browser, and neither identifies you: your cookie choice (kb_consent, in local storage, kept for 12 months so we don’t ask you on every page), and a note that you’ve already seen the opening animation (kbPre, in session storage, cleared when you close the tab). Fonts are served from our own server, not from a third party.
Analytics (only if you say yes). If you allow analytics, we use analytics providers to understand how the site is used, so we can make it more useful. They measure which pages you visit, how you arrived (for example from a search or a link), how long you stay, how far you scroll and what you click, plus your device type, browser, screen size and approximate location (country or city, worked out from your IP address). This includes heatmaps and session recordings, which show how visitors move through a page. Recordings are set to mask what you type, so the contents of form fields, such as your name or email address, are not recorded. Analytics sets cookies on your device: one holds a random visitor identifier and lasts up to 2 years; others last between one day and one year and link the pages of a single visit together. One analytics provider may also set a cookie on its own domain, which we can’t remove for you; you can clear it in your browser settings. Our legal basis is your consent, and you can withdraw it at any time.
Advertising (not used). We don’t use advertising tools on this site. If we add them in future, we will update this page first and ask you again, and they will run only if you switch advertising on. What you type into the contact, booking or newsletter forms, including your email address, is never shared with advertising tools.
Global Privacy Control. If your browser sends a Global Privacy Control signal, we treat it as a “no” to advertising.
Changing your mind. Use Cookie settings at the foot of every page to change your choice at any time. If you switch analytics off, it stops running and we remove the analytics cookies this site has set in your browser; any cookie set on a provider’s own domain can be cleared in your browser settings. Saying no never changes how the site works. Your choice is kept for 12 months; after that, we ask again.
Who provides it. Our analytics providers are based in the United States and may process information in other countries where they operate, so it may be processed outside Jamaica. They handle it to provide the analytics service to us, and may also use it, under their own privacy terms, to maintain and improve their services. You can ask for a current list of the providers we use by emailing grow@kemalbrown.com.
How long it’s kept. Analytics reports: up to 14 months, then deleted. Session recordings: up to 30 days, or up to 9 months for a small number we keep for review. Heatmaps: up to 9 months, combined so no single visit stands out. Your saved cookie choice: 12 months.
Like every website, our hosting server keeps standard technical logs of each request (IP address, browser type, the page requested and the time). We use them only to keep the site secure and working.
Why we use it, and our legal basis
| Purpose | Legal basis |
|---|---|
| Replying to your enquiry and planning a booking | Steps you ask us to take before an agreement, and our legitimate interest in answering messages |
| Sending the newsletter or podcast updates you asked for | Your consent, which you can withdraw at any time with the unsubscribe link |
| Keeping a record that you signed up or unsubscribed | Our legal obligations and legitimate interest in proving consent |
| Sending the Speaker Kit you asked for, and occasional emails about Kemal’s speaking | Steps you ask us to take (sending the kit), and your consent for the follow-up emails, which you can withdraw at any time with the unsubscribe link |
| Measuring how the site is used (analytics, including heatmaps and session recordings), only if you allow it | Your consent, which you can withdraw at any time under Cookie settings |
| Blocking spam and keeping the site secure (including server logs) | Legitimate interest |
We don’t make automated decisions about you that have legal or similarly significant effects.
Who we share it with
We use trusted service providers for hosting, email, newsletters and, only if you allow it, analytics. They process personal information only on our instructions. You can ask us for a current list of the providers we use by emailing grow@kemalbrown.com.
- Our website hosting provider (United States) — hosts the website and the forms; keeps standard server logs (IP address, browser, pages requested, time) and the backup copies of form messages and sign-ups described above.
- Our email provider (United States) — delivers form messages and sign-up alerts to our inbox: what you typed into the form, or your name and email address.
- Our newsletter (email marketing) provider (United States) — sends our newsletter, podcast and Speaker Kit emails and stores the subscriber list: your email address, first name (if given) and email opens and clicks.
- Our analytics providers (outside Jamaica) — only if you allow analytics: measure how the site is used, as described under Cookies and analytics. What you type into forms is not sent to them.
We may also disclose information if the law requires it. We never sell or rent your personal information, and we never share it with others for their own marketing.
International transfers
Our hosting, email, newsletter and analytics providers are based in, and process data in, the United States and may use facilities in other countries where they operate, so your information may be processed outside Jamaica. Where the law requires it, including Jamaica’s Data Protection Act 2020, we rely on appropriate safeguards, such as the providers’ data processing terms and, for visitors from the EU/EEA, the UK or Switzerland, the European Commission’s Standard Contractual Clauses or the EU–US / UK–US Data Privacy Framework where the provider is certified.
How long we keep it
- Enquiries and booking requests: up to 2 years after our last contact with you, then deleted, unless a booking leads to an agreement we must keep records of for longer.
- Backup copies of form messages and sign-ups on our server: up to 12 months, then deleted.
- Spam-protection records (hashed IP address): about 2 days.
- Newsletter, podcast and Speaker Kit subscribers: until you unsubscribe. After that we keep only your email address on a “do not contact” list, so we never email you again by mistake.
- Server logs: kept by our website hosting provider for a short period under its standard settings, for security and troubleshooting.
- Analytics (only if you allow it): reports up to 14 months; session recordings up to 30 days (up to 9 months for a small number kept for review); heatmaps up to 9 months, combined.
- Your cookie choice: 12 months in your browser’s local storage, then we ask again.
Your rights
Under Jamaica’s Data Protection Act 2020, and wherever you live, you can ask us to:
- Access — tell you what information we hold about you, why, and who receives it, and give you a copy.
- Correct — fix information that is wrong or incomplete.
- Delete — erase your information.
- Stop direct marketing — unsubscribe at any time using the link in every email, or by writing to us. We’ll act on it promptly, and in any case within 10 business days.
- Object — ask us to stop processing that is causing or is likely to cause you damage or distress.
- Withdraw consent — for the newsletter or podcast updates, at any time. Withdrawing consent doesn’t affect anything we did before.
If you are in the EU/EEA, the UK or Switzerland, you also have the rights to restrict processing and to data portability.
To use any of these rights, email grow@kemalbrown.com. We may need to confirm your identity first. We will respond within 30 days.
Complaints
Please contact us first so we can try to put things right. You also have the right to complain to a regulator:
- Jamaica: the Office of the Information Commissioner (OIC) — oic.gov.jm.
- EU/EEA: your local data protection authority.
- UK: the Information Commissioner’s Office — ico.org.uk.
